1. Introduction

These are the terms of use ("Terms of Use") for your use of services or features on Sephora’s career site, available at https://join.sephora.com/careers, or any other site these Terms of Use appear on (the “Sites”). You may be accessing our Sites from a computer or mobile phone device (through an iPhone application, for example) and these Terms of Use govern your use of our Sites and your conduct, regardless of the means of access.

PLEASE NOTE: THESE TERMS CONTAIN A CLASS ACTION WAIVER AND JURY TRIAL WAIVER, AS DETAILED IN THE “AGREEEMENT TO WAIVE JURY TRIAL AND CLASS ACTIONS” SECTION, BELOW.

BY USING THE SITES, YOU SIGNIFY YOUR AGREEMENT TO THESE TERMS OF USE (INCLUDING THE JURY TRIAL AND CLASS ACTION WAIVERS BELOW) AND OUR PRIVACY POLICY, WHICH IS HEREBY INCORPORATED BY THIS REFERENCE. PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY AGREEING TO THESE TERMS OF SERVICE, YOU ALSO CONSENT TO OUR COLLECTION, USE AND DISCLOSURE OF INFORMATION YOU PROVIDE US IN ACCORDANCE WITH OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY OF THESE, YOU SHOULD NOT USE OUR SITES.

Sephora reserves the right to change or modify any of the terms and conditions contained in the Terms of Use from time to time at any time, without notice, and in its sole discretion. If Sephora decides to change these Terms of Use, Sephora will post a new version on the Sites and update the “Last Updated” date set forth above. ANY CHANGES OR MODIFICATIONS TO THESE TERMS OF USE, GUIDELINES OR RULES WILL BE EFFECTIVE UPON POSTING OF THE REVISIONS. THE UPDATED TERMS OF USE WILL REPLACE THE PRIOR VERSION AND ARE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES, REGARDLESS OF WHEN THE DISPUTED INTERACTIONS AROSE. For this reason, you should frequently review these Terms of Use and any other applicable policies, including their dates, to understand the terms and conditions that apply to your use of the Sites.

2. Copyright

All design, text, graphics, logos, button icons, images, audio, video clips, and similar materials, the selection and arrangement thereof, and all software on the Sites is Copyright (c) 1999-2024 Sephora USA, Inc., ALL RIGHTS RESERVED. The compilation (meaning the collection, arrangement and assembly) of all content on the Sites is the exclusive property of Sephora and protected by U.S. and international copyright laws. All software used on the Sites is the property of Sephora or its software suppliers and is protected by U.S. and international copyright laws. Subject to your compliance with these Terms of Use, Sephora grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Sites. This license does not include: (a) any commercial use of this Sites or its contents; (b) any derivative use of the Sites or its contents; (c) any downloading, copying or other use of the Sites or its contents for the benefit of any third party; or (d) any use of data mining, robots or similar data gathering and extraction tools. Any other commercial use of materials on the Sites - including reproduction for purposes other than those permitted above, modification, distribution, republishing, transmission, display or performance - without the prior written permission of Sephora is strictly prohibited. 3. Trademarks

Sephora.com and all page headers, custom graphics and button icons are service marks, trademarks, and/or trade dress of Sephora.

4. Account

To apply for positions with Sephora, you must create an account to access the Sephora career portal. You must provide accurate account information, including personal information, and promptly update this information if it changes, and you hereby agree to receive emails, SMS messages, and other types of communication from Sephora using the email address or other contact information that you provide in connection with your account. You must maintain the security of your account and promptly notify Sephora if you discover or suspect that someone has accessed your account without your permission. You may not share your account information or credential with any other person or entity, and may not permit any other person or entity to use your account information or credentials. You are solely responsible for all activity performed under your account. We reserve the right to reject, require that you change or reclaim account information, or to terminate your account at any time, with or without notice. You agree that Sephora may, in Sephora’s sole discretion, terminate any rights to your account.

5. Responsibility for your Content

You are solely responsible for all content that you upload, post, email or otherwise transmit via or to the Sites, including the submission of job applications, and all profile information, documents, text, software, applications, photographs, video, messages or other materials (collectively, "Content").

6. Your Use of Content on the Sites

Sephora provides the Sites and all other applications and services on the Sites for your convenience only.

You may access the Sites and its services only as permitted under these Terms of Use and the Privacy Policy and you represent and warrant to Sephora that you will not use the Sites for any purpose that is unlawful or prohibited by these Terms of Use. Whether on behalf of yourself or on behalf of a third party, when you use the Sites, you may NOT:

Violate any law or regulation;

Engage in any harassing, threatening, intimidating, predatory or stalking conduct;

Use or attempt to use another user’s account or information, share your log-in information, or otherwise allow any other person or entity to use your account, without authorization from that user and Sephora;

Impersonate someone or submit an application on behalf of any person that you are not authorized to represent, or misrepresent your affiliation with a person or entity;

Use the Sites or services to do anything unlawful, misleading, malicious, or discriminatory, or otherwise promote any criminal or illegal activity, or provide instructional information about illegal activity;

Access (or attempt to access) areas or features of this Sites for which you do not have the proper authorization;

Use the Sites or services in a way that we determine, in our sole discretion, restricts or inhibits any other users from using this Sites;

Use the Sites or services other than for their intended purpose;

Attempt to circumvent any technological measure implemented by Sephora or any of Sephora's providers or any other third party to protect the Sites or services;

Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Sites or services;

Engage in spidering or harvesting, or participate in the use of software, including spyware, designed to collect data from the Sites or services;

To circumvent, disable or otherwise interfere with security-related features of the Sites or features that prevent or restrict use of any Content or enforce limitations on use of the Sites or the Content therein;

Interfere with or disrupt the Sites, or servers or networks connected to the Sites, or disobey any requirements, procedures, policies or regulations of networks connected to the Sites, including by using any device, software or routine to bypass robot exclusion headers; and

Advocate, encourage, or assist any third party in doing any of the foregoing.

7. Mobile Services

If you access the Sites via your mobile phone (through an iPhone application, for example), we do not currently charge for this access. Additionally, you may receive text messages or calls from us related to certain products or services. Please be aware that if you access the Sites via your mobile phone or provide a mobile phone number to us in order to be contacted by voice or text message, your carrier’s normal rates and fees, such as text messaging fees or data charges, will still apply. 8. Confidentiality of Content

All Content that you submit is not confidential and may be used at Sephora’s sole discretion. Sephora reserves the right to incorporate any Content you have submitted into any account you may have, now or in the future, as a registered user of the Sites. You acknowledge that you, not Sephora, are responsible for the contents of any Content you submit. None of the Content that you submit shall be subject to any obligation of confidence on the part of Sephora, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.

9. Reservation of Rights

Sephora reserves the right, at any time, without notice and in its sole discretion, to terminate your license to use the Sites and to block or prevent your future access to and use of the Sites. Sephora may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (i) comply with legal process; (ii) enforce these Terms of Use or (iii) protect the rights, property or personal safety of Sephora (and its employees).

10. Disclaimer of Warranties

SEPHORA IS PROVIDING THE SITES ON AN “AS-IS” BASIS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE OPERATION OF THE SITES, THE INFORMATION OR CONTENT INCLUDED ON THE SITES. TO THE FULLEST EXTENT PERMITTED BY LAW, SEPHORA DISCLAIMS ALL SUCH REPRESENTATIONS AND WARRANTIES. IN ADDITION, SEPHORA DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THE SITE IS ACCURATE, COMPLETE OR CURRENT. Please note that some jurisdictions may not allow the exclusion of implied warranties and conditions, so some of the above exclusions may not apply to you but shall apply to the maximum extent permitted by applicable law.

11. Disclaimer of Liabilities

UNDER NO CIRCUMSTANCES WILL SEPHORA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS OR SERVICE PROVIDERS, OR ANY OF THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS (“RELEASED PARTIES”), BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSSES OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SITES, ITS CONTENT, OR POSTINGS AVAILABLE THROUGH THE SITES, OR YOUR USE OF OR INABILITY TO USE THE SITES AND ITS SERVICES, INCLUDING ANY LOSS OR DAMAGE DUE TO VIRUSES THAT MAY AFFECT YOUR ELECTRONIC EQUIPMENT, SOFTWARE, DATA OR OTHER PROPERTY ON ACCOUNT OF YOUR USE OF THE SITES OR YOUR DOWNLOADING OF ANY CONTENT FROM THE SITES. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIESWHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF AN AUTHORIZED REPRESENTATIVE OF SEPHORA OR ANOTHER RELEASED PARTY HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND WITHOUT REGARD TO THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES. YOU AGREE THAT WE WOULD NOT ENTER INTO THESE TERMS OF USE WITHOUT THESE LIMITATIONS ON OUR LIABILITY. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. This provision does not apply to New Jersey residents.

12. Indemnification

By accepting these Terms of Use, you agree to defend, indemnify and hold harmless Sephora and the Released Parties, from all claims, demands, losses, liabilities, costs, expenses, obligations and damages including reasonable legal fees, arising out of (a) your misuse of the Sites; (b) your violation of any term of these Terms of Use; (c) a breach of your representations and warranties set forth above regarding Content; (d) your violation of any law or the rights of a third party (including, without limitation, any copyright, property or privacy right); (e) any claim that any Content you submitted caused damage to a third party; or (f) sharing your login credentials for the Sites without Sephora’s express authorization. You agree to promptly notify Sephora of any claims, cooperate with Sephora in defending such claims and pay all fees, costs and expenses associated with defending such claims (including attorneys' fees). You also agree that Sephora will have control of the defense or settlement, at Sephora’s sole option, of any claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and any of the Released Parties.

This indemnification obligation will survive the termination of these Terms of Use.

13. Privacy

By submitting your personal information, such as your email address, similar contact information and resume, in connection with your account or application, you agree that Sephora and its Service Providers may use your email address to contact you about your Sephora Talent Community account, or to communicate about job opportunities, or for other administrative purposes and for any other purpose permitted or required by law. Sephora's Applicant Privacy Policy provides further detail on the manner in which Sephora may collect and use your personal information.

14. Waiver

No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Sephora's failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

15. Dispute Resolution

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND SEPHORA AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. The preceding sentence does not apply to New Jersey residents.

16. Informal Dispute Resolution

In the unlikely event that a disagreement arises between you and Sephora regarding any claim or controversy at law or equity arising out of, relating to, or connected in any way with your use of the Sites (collectively, “Dispute”), prior to initiating any legal action, you must first contact us directly by email at legalinquiries@sephora.com. You must describe the nature of the Dispute, the basis for your Dispute and the resolution you are seeking.

You agree that the term “Dispute” in these Terms and Conditions will have the broadest meaning possible. These Terms and Conditions also cover any Dispute between you and any Released Party if Sephora could be liable, directly or indirectly, for such Dispute.

During the 60 days from the date you first contacted us, you and we agree to engage in good faith efforts to resolve the Dispute and you will not initiate any legal action in court until this time period has expired. During this 60-day time period you and we agree to toll any statutes of limitations that may apply, along with any filing deadlines.

17. Agreement to Waive Jury Trial and Class Actions

IF YOU ARE A U.S. RESIDENT, YOU ALSO AGREE TO THE FOLLOWING:

PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND TO HAVE A TRIAL IN FRONT OF A JURY

NO CLASS ACTIONS: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.

WAIVER OF JURY TRIAL: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS THEY MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTES WHATSOEVER BETWEEN THE PARTIES, INCLUDING BUT NOT LIMITED TO, DISPUTES IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS OR THE RELATIONSHIP OF THE PARTIES (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY).

18. Choice of Law/Forum Selection

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law rules, without giving effect to any conflict of laws rules or provisions. You further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in San Francisco County, California, and waive any jurisdictional, venue, or inconvenient forum objections to such courts for any claim or cause of action arising out of or relating in any way to the Site, or these Terms of Use.

19. Severability

The provisions of these Terms of Use are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by Sephora, or a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Terms of Use without affecting the validity, legality or enforceability of any of the remaining provisions.

20. Notice to California Consumers

Under California Civil Code Section 1789.3, California consumers are entitled to the following consumer rights notice: The provider of the Sites is Sephora USA, Inc., located at 350 Mission Street, 7th Floor, San Francisco, CA 94105. California consumers may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at 916-445-1254 or 1-800-952-5210.

21. Release

To the fullest extent permitted by applicable law, you forever release and discharge Sephora and the other Released Parties from any and all responsibility, liability, claims, demands, causes of action, and/or damages (actual and consequential) of every kind and nature, known and unknown (including claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties. If you are a consumer who resides in California, you hereby waive your rights under California Civil Code Section 1542, which provides:

A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that if known by him or her, would have materially affected his or her settlement with the debtor or released party.
